Terms of Service
These terms govern your access to and use of AI&Humn. By creating an account or using the service, you agree to them.

1. Agreement
These Terms of Service ("Terms") are a binding agreement between you (or the organisation you represent) and AI & Humn Technologies Pvt Ltd ("AI&Humn", "we", "us"). By signing up for, accessing, or using the service, you agree to these Terms and to our Privacy Policy. If you are agreeing on behalf of an organisation, you confirm you have authority to bind it.
2. The service
AI&Humn provides a platform to build and embed AI voice assistants on your websites and apps, including knowledge grounding, lead capture, behavioural triggers, usage analytics, and related features. Features available to you depend on your plan.
3. Accounts & eligibility
- You must provide accurate information and keep your account credentials secure.
- You are responsible for all activity under your account.
- The service is intended for business use by users who can form a binding contract.
- Notify us promptly at contact@aiandhumn.com of any unauthorised use.
4. Free trial
We offer a 14-day free trial on the Starter plan, with no credit card required at sign-up. At the end of the trial, you may add a payment method to continue. If you do not, your account becomes read-only (you keep dashboard access, but the voice widget is paused) until you subscribe. Trials are limited to the Starter plan and may be subject to fair-use limits.
5. Subscriptions, billing & auto-renewal
- Paid plans are billed in advance on a monthly or annual cycle, in the currency determined by your billing country (INR via Razorpay; other currencies via Paddle as Merchant of Record). Applicable taxes are added at checkout or handled by our Merchant of Record.
- Subscriptions auto-renew at the end of each cycle at the then-current price for your plan, unless you cancel before the renewal date.
- Monthly quotas refresh each month on successful payment. Annual subscribers receive a monthly quota refresh across the year of their term.
- If a renewal payment fails, we (or our payment processor) may retry. After repeated failures your subscription may be marked past-due and the voice widget paused until payment succeeds.
6. Usage limits & top-ups
- Each plan includes a monthly allowance of voice minutes, pooled across your widgets.
- Individual calls are capped at a maximum duration (currently 30 minutes per call) to bound runaway usage.
- You may purchase additional minute top-up packs. Subscription minutes are consumed first; top-up minutes are consumed after, oldest-expiring first.
- Top-up minutes expire 12 months from the date of purchase and do not roll over or refresh. Unused minutes at expiry are forfeited and are not refundable.
- When your available minutes are exhausted, new calls are paused until your quota refreshes or you purchase a top-up.
7. Price changes
We may change plan prices. For existing subscribers, a price change takes effect at your next renewal, not mid-cycle — the price you signed up for is locked for your current paid period. Where a price increase will apply, we give you advance notice before it takes effect so you can review or cancel.
8. Refunds & cancellation
You can cancel anytime from your billing settings; cancellation takes effect at the end of your current paid period, and you keep access until then.
- Subscriptions: within 7 days of a charge, we offer a refund for accidental or disputed charges — prorated for unused days, or in full if no call minutes were used in the period.
- Top-ups: non-refundable once any minute from the pack has been used; if no minutes were used, a full refund is available within 7 days of purchase.
- Annual plans: a prorated refund is available for fully unused complete months; no partial-month refunds after usage in that month.
Refunds are returned via the original payment method/gateway.
9. Acceptable use
You agree not to, and not to permit others to:
- Use the service for unlawful, deceptive, fraudulent, or harmful purposes.
- Deploy a voice assistant for spam, harassment, or to impersonate a person or entity deceptively.
- Attempt to defeat usage limits, probe or breach security, or disrupt the service.
- Upload content you do not have the rights to, or that is illegal, infringing, or malicious.
- Resell or sublicense the service except as expressly permitted.
We may suspend accounts that violate this section.
10. Your content & responsibilities
- You retain ownership of the knowledge content you upload and the data your assistants collect. You grant us the limited rights needed to host and process it to provide the service.
- You are responsible for the assistants you deploy and for complying with the laws that apply to your use — including obtaining any consent required to record or process voice conversations with your visitors, and providing your own privacy notices to them.
- Where we process personal data on your behalf, we act as your processor; you are the controller and are responsible for the lawful basis of that processing.
11. Intellectual property
The service, including its software, design, and trademarks, is owned by AI&Humn and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing. We may use aggregated, de-identified usage data to operate and improve the service.
12. Third-party services
The service relies on third parties (e.g. our voice provider and payment processors). Your use may also be subject to their terms. We are not responsible for third-party services outside our control, though we choose providers we consider reputable.
13. Disclaimers
The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated responses will be accurate or suitable for every situation.
14. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data. Our total aggregate liability arising out of or relating to the service is limited to the amount you paid us for the service in the 12 months before the event giving rise to the claim.
15. Indemnification
You agree to indemnify and hold AI&Humn harmless from claims arising out of your content, your deployment of assistants, or your breach of these Terms or of applicable law, to the extent permitted by law.
16. Suspension & termination
- You may stop using the service and close your account at any time.
- We may suspend or terminate access for material breach of these Terms, non-payment, or to comply with law, with notice where practicable.
- On termination, your right to use the service ends; certain provisions (e.g. payment owed, IP, disclaimers, limitation of liability, governing law) survive.
17. Governing law & disputes
These Terms are governed by the laws of India. The courts at Mumbai, Maharashtra have jurisdiction, subject to any mandatory consumer-protection rights you have where you live.
18. Changes to these Terms
We may update these Terms from time to time. We will revise the "last updated" date above and, for material changes, provide additional notice. Continued use after an update means you accept the revised Terms.
